Terms of service

These terms apply to your use of this website and to any order you place with Hazel and Rowe. Please read them before ordering. By placing an order you accept these terms.

Who we are

This store is operated by Hazel and Rowe, trading as Hazel & Rowe by Gabrielle. We trade from Shop 6a, Sun Valley Road Marketplace, 85 Sun Valley Road, Gladstone QLD 4680, Australia, and you can reach us by email at hazelandrowe@outlook.com or by phone on 0409 092 191. Our shop is open Monday to Friday 8.30am to 5pm and Saturday 8.30am to 2pm, and is closed on Sundays and public holidays.

Where we sell

We sell and deliver within Australia only at this stage. Orders with a delivery address outside Australia cannot be completed. If you are outside Australia and would like to order, email hazelandrowe@outlook.com and we will let you know when international delivery becomes available.

Orders

Placing an order is an offer to buy. Your order is accepted when we send you a confirmation or dispatch it, whichever happens first. We may decline or cancel an order, for example where an item is unavailable, where a price or description was published in error, or where we cannot verify your delivery or payment details. If we cancel an order you have paid for, we will refund it in full.

Because many pieces are made in small quantities and some are one of a kind, an item may sell out while it is still in your cart. Adding an item to your cart does not reserve it.

Prices and payment

Prices are shown in Australian dollars. Hazel & Rowe is not currently registered for GST, so no GST is charged on your order and prices are not subject to GST. Shipping charges are shown separately at checkout before you pay. Payment methods available to you are displayed at checkout, and payment is processed by our payment providers rather than by us. We do not store your full card details.

We may change prices at any time, but a change will not affect an order we have already accepted.

Natural materials and product images

Freshwater pearls, semi-precious stones and shells are natural materials, so shape, size, colour and markings vary between pieces. Variation of this kind is a characteristic of the material rather than a fault, and the piece you receive may differ slightly from the photographs. We describe materials and finishes as accurately as we can, and screen colours vary between devices.

Where a piece is described as waterproof or tarnish resistant, that description applies to the complete item as identified in its product details. Please follow the guidance in our jewellery care guide.

Delivery

Delivery times, charges and tracking are set out in our shipping policy, which forms part of these terms. Delivery estimates are estimates, not guaranteed arrival dates.

Returns, refunds and your consumer rights

Our returns and exchanges policy forms part of these terms and explains how to return an item.

Nothing in these terms excludes, restricts or modifies the consumer guarantees that apply under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded. For a major failure you may choose a refund or replacement, and for other failures we may repair, replace or refund as the law requires. You may also be entitled to compensation for reasonably foreseeable loss or damage. Any change of mind terms we offer are in addition to those rights, not instead of them.

Gift cards

Gift cards are valid for three years from the date of issue, as required by Australian law, and the expiry date is shown on the card. A gift card can be used on anything we sell; it is not limited to particular pieces, materials or collections. Gift cards are redeemable on this website at checkout and cannot be exchanged for cash. If an order comes to less than the value of the card, the remaining balance stays on the card and can be used on a later order at any time within the same three year period; where the card has been used with a customer account, the balance is shown in that account. Treat a gift card like cash; we are not responsible for a card lost or used without your permission, except as required by law.

Using this website

Please use this website lawfully and reasonably. Do not attempt to interfere with its operation or security, use it to send unsolicited commercial messages, collect data from it by automated means without our permission, or place orders fraudulently or on someone else's behalf without authority.

If you create an account or subscribe to our emails, keep your details accurate and your password secure. You can unsubscribe from marketing emails at any time.

Our content

The Hazel & Rowe name, logo, photography, product descriptions and website content belong to us or our licensors, and are protected by copyright and trade mark law. You may view and share our content for personal, non-commercial purposes. Please do not reproduce it commercially, or use our name or logo, without our written permission.

Links to other websites

Where we link to another website or service, we do so for convenience. We do not control those sites and are not responsible for their content or their terms.

Liability

Subject to the Australian Consumer Law and other rights that cannot be excluded, we are not liable for loss or damage that was not reasonably foreseeable, and our liability for any claim relating to an item is limited to the amount you paid for it. We do not promise the website will always be available or free of errors.

Changes to these terms

We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order.

Governing law

These terms are governed by the laws of Queensland, Australia, and the courts of that jurisdiction and the Commonwealth of Australia have jurisdiction over any dispute.
